Welcome to Happy High! These Terms of Use govern your access to and use of the Happy High mobile application and website (happyhigh.life). By using Happy High, you agree to these terms. Happy High is owned and operated by FreeDAIY Pty Ltd (ABN pending), an Australian company.

By downloading, installing, or using Happy High, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please do not use Happy High.
Happy High offers a premium subscription ("Happy High Premium") that unlocks unlimited sessions, detailed analytics, real-time coaching, and VO₂max tracking.
Both options include a 7-day free trial. You will not be charged during the trial period.
New subscribers receive a 7-day free trial. Your subscription begins at the end of the trial period unless you cancel before the trial ends. You may only use one free trial per Apple ID.
All purchases are processed through Apple's App Store. Refund requests must be submitted directly to Apple. FreeDAIY Pty Ltd does not have the ability to process refunds for App Store purchases.
To request a refund from Apple, visit reportaproblem.apple.com or contact Apple Support. Refunds are granted at Apple's discretion in accordance with their refund policy.
Happy High is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
The information provided by Happy High, including heart rate data, zone calculations, and any insights or recommendations, is for informational and educational purposes only. It should not be considered medical advice or a substitute for professional medical consultation, diagnosis, or treatment.
Before starting any exercise program, including using Happy High to guide your workouts, you should consult with a qualified healthcare provider, especially if you:
Stop exercising immediately and seek medical attention if you experience chest pain, dizziness, shortness of breath, nausea, or any other concerning symptoms during exercise.
The "Happy High Zone" (70-80% of estimated maximum heart rate) is based on general fitness guidelines and may not be appropriate for everyone. Your actual optimal exercise intensity should be determined in consultation with a healthcare professional who knows your medical history.
Happy High, including all content, features, functionality, software, text, graphics, logos, and trademarks, is owned by FreeDAIY Pty Ltd and is protected by Australian and international copyright, trademark, and other intellectual property laws.
"Happy High," "Happy High Zone," the Happy High logo (smiley face with headband), and related branding are trademarks of FreeDAIY Pty Ltd. You may not use these marks without our prior written permission.
Your use of Happy High grants you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes in accordance with these Terms.
To the maximum extent permitted by applicable law:
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless FreeDAIY Pty Ltd and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of these Terms and, where appropriate, through in-app notifications or App Store release notes.
Your continued use of Happy High after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you should stop using Happy High and cancel your subscription.
We may terminate or suspend your access to Happy High immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use Happy High will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of Happy High shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
If you are a consumer in the European Union, you may also have rights under the laws of your country of residence.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FreeDAIY Pty Ltd regarding your use of Happy High and supersede all prior agreements, understandings, and communications, whether written or oral.

The following terms apply to your use of Happy High downloaded from Apple's App Store. These terms are required by Apple and supplement the Terms of Use above.
You acknowledge that this End-User License Agreement ("EULA") is concluded between you and FreeDAIY Pty Ltd ("Developer") only, and not with Apple Inc. ("Apple"). FreeDAIY Pty Ltd, not Apple, is solely responsible for Happy High and its content. Apple is not a party to this agreement.
The license granted to you for Happy High is a limited, non-exclusive, non-transferable license to use the app on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to use Happy High on any device you do not own or control, and you may not distribute or make Happy High available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, redistribute, or sublicense Happy High. Family Sharing access is permitted where applicable under Apple's Usage Rules.
FreeDAIY Pty Ltd is solely responsible for providing any maintenance and support services for Happy High, as specified in this EULA or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Happy High.
FreeDAIY Pty Ltd is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Happy High to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for Happy High to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Happy High, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be FreeDAIY Pty Ltd's sole responsibility.
You acknowledge that FreeDAIY Pty Ltd, not Apple, is responsible for addressing any claims you or any third party may have relating to Happy High or your possession and/or use of Happy High, including but not limited to: (i) product liability claims; (ii) any claim that Happy High fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. This EULA does not limit FreeDAIY Pty Ltd's liability to you beyond what is permitted by applicable law.
You acknowledge that, in the event of any third-party claim that Happy High or your possession and use of Happy High infringes that third party's intellectual property rights, FreeDAIY Pty Ltd, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You also agree to comply with all applicable local, state, national, and international laws and regulations in connection with your use of Happy High.

You must comply with applicable third-party terms of agreement when using Happy High. For example, if you use Happy High with a Bluetooth heart rate monitor, you must not violate your agreement with the device manufacturer. Additionally, when using Happy High, you must comply with the terms of any wireless data service agreement with your mobile carrier.
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
